The featured case discussion on the role of consent and individual autonomy in the PIP breast implant scandal raises interesting and important questions regarding the right of patients (and individuals in general) to decide whether to have their personal data included in medical registries and used for research. The fate of the National Breast Implant Registry, following the introduction of a policy that demanded formally recorded informed consent, is particularly enlightening. Combined with the (ex post) fact that reliable and comprehensive (...) data would have been useful in this specific case, it clearly illustrates the dangers of overemphasizing individual autonomy in observational research. The issue is timely, as the European Commission has recently proposed a new Data Protection Regulation (European Commission, 2012) that may have serious implications for registry based research. In this commentary, I will first discuss two aspects of the regulatory framework that arguably contribute to the problematic situation and then offer an alternative view on why requiring consent should not be the default position in this kind of research. Our starting point in this article is the debate between John Harris and Iain Brassington on whether or not there is a duty to take part in scientific research. We consider the arguments that have been put forward based on fairness and a duty to rescue, and suggest an alternative justification grounded in a hypothetical agreement: that is, because effective healthcare cannot be taken for granted, but requires continuous medical research, and nobody knows what kind of healthcare they will need, (...) participating in research should be viewed from the perspective of a social contract, based on our mutual need for medical advances. In this commentary on ‘Why participating in scientific research is a moral duty’, I take issue with a number of Stjernschantz Forsberg et al's claims. Though abiding by the terms of a contract might be obligatory, this won't show that those terms themselves indicate a duty—even allowing that there's a contract to begin with. Meanwhile, though we might have reasons to participate, not all reasons are moral reasons, and the paper does not establish that the reasons here are (...) moral in character. (shrink)

Would compulsory treatment or vaccination for Covid-19 be justified? In England, there would be significant legal barriers to it. However, we offer a conditional ethical argument in favour of allowing compulsory treatment and vaccination, drawing on an ethical comparison with external constraints—such as quarantine, isolation and ‘lockdown’—that have already been authorised to control the pandemic. We argue that, if the permissive English approach to external constraints for Covid-19 has been justified, then there is a case for a similarly permissive approach (...) to compulsory medical interventions. The paper concerns Grzegorczyk’s non-Fregean logics that are intended to be a formal representation of the equimeaning relation defined on descriptions. We argue that the main Grzegorczyk logics discussed in the literature are too strong and we propose a new logical system, \, which satisfies Grzegorczyk’s fundamental requirements. We present a sound and complete semantics for \ and we prove that it is decidable. Finally, we show that many non-classical logics are extensions of \, which makes it a generic non-Fregean (...) logic. (shrink)

We show that there are continuum many different extensions of SCI (the basic theory of non-Fregean propositional logic) that lie below WF (the Fregean extension) and are closed under substitution. Moreover, continuum many of them are independent from WB (the Boolean extension), continuum many lie above WB and are independent from WH (the Boolean extension with only two values for the equality relation), and only countably many lie between WH and WF.

A growing body of research is exploring corporate communication in relation to corporate social responsibility (CSR) activities on social media (SM). Nonetheless, while these studies have shown that SM communication may be an effective tool for reaching and engaging various stakeholders, how the design of corporate CSR communication engenders trustworthiness has yet to be examined. To address this gap, we suggest that SM communication may include important signals related to trust; thus, we investigate whether companies use sources of trustworthiness (reputation, (...) performance, and appearance) while communicating with stakeholders and the response of the latter to such communication. Our empirical analysis is based on a database containing over 66,000 CSR-related messages from eight companies focusing on communication extracted from Twitter. These data are coded according to three sources of trustworthiness and two dimensions of CSR communication (social and environmental). Our findings indicate that all three attributes of trustworthiness are used by companies in their CSR social media communication. We also document how corporate efforts to use CSR communication that engenders trustworthiness influence stakeholder engagement. Our study therefore contributes to the literature on trust in relation to CSR by illustrating the importance of signaling that includes different sources of trustworthiness or their combination in corporate communication. By analyzing how the various trust attributes included in CSR communication affect SM reactions, we also identify which attributes lead to greater stakeholder engagement overall, particularly for the two analyzed dimensions of CSR communication. The current study explores the effects of a brief training program on complex problem solving (CPS) and dynamic decision making (DDM) performance in two computer-simulated tasks with different task characteristics, ChocoFine (N = 76) and WinFire (N = 99). Half of the participants in each simulation group received a brief training on 16 frequent CPS and DDM errors. We hypothesized that participants who received the training in errors would show better performance, report fewer errors, and show fewer behavioral errors compared (...) to those who did not receive the error training prior to the start of the simulated tasks. The results showed that participants in both training groups had better performance scores. Participants in the training condition reported fewer self-reported errors compared to the no-training group only in the ChocoFine simulation. Regarding behavioral errors, status-quo bias was related to weaker performance in both simulations. These findings have implications for leaders who are prone for the status-quo bias and for organizations which could implement trainings programs for DDM and CPS. (shrink)

Qualitative Reasoning (QR) is an area of research within Artificial Intelligence that automates reasoning and problem solving about the physical world. QR research aims to deal with representation and reasoning about continuous aspects of entities without the kind of precise quantitative information needed by conventional numerical analysis techniques. Order-of-magnitude Reasoning (OMR) is an approach in QR concerned with the analysis of physical systems in terms of relative magnitudes. In this paper we consider the logic OMR_N for order-of-magnitude reasoning with the (...) bidirectional negligibility relation. It is a multi-modal logic given by a Hilbert-style axiomatization that reflects properties and interactions of two basic accessibility relations (strict linear order and bidirectional negligibility). Although the logic was studied in many papers, nothing was known about its decidability. In the paper we prove decidability of OMR N by showing that the logic has the strong finite model property. A non-Fregean framework aims to provide a formal tool for reasoning about semantic denotations of sentences and their interactions. Extending a logic to its non-Fregean version involves introducing a new connective$$\equiv $$≡that allows to separate denotations of sentences from their logical values. Intuitively,$$\equiv $$≡combines two sentences$$\varphi $$φand$$\psi $$ψinto a true one whenever$$\varphi $$φand$$\psi $$ψhave the same semantic correlates, describe the same situations, or have the same content or meaning. The paper aims to compare non-Fregean paraconsistent Grzegorczyk’s logics (Logic of Descriptions$$\textsf{LD}$$LD, (...) Logic of Descriptions with Suszko’s Axioms$$\textsf{LDS}$$LDS, Logic of Equimeaning$$\textsf{LDE}$$LDE) with non-Fregean versions of certain well-known paraconsistent logics (Jaśkowski’s Discussive Logic$$\textsf{D}_2$$D2, Logic of Paradox$$\textsf{LP}$$LP, Logics of Formal Inconsistency$$\textsf{LFI}{1}$$LFI1and$$\textsf{LFI}{2}$$LFI2). We prove that Grzegorczyk’s logics are either weaker than or incomparable to non-Fregean extensions of$$\textsf{LP}$$LP,$$\textsf{LFI}{1}$$LFI1,$$\textsf{LFI}{2}$$LFI2. Furthermore, we show that non-Fregean extensions of$$\textsf{LP}$$LP,$$\textsf{LFI}{1}$$LFI1,$$\textsf{LFI}{2}$$LFI2, and$$\textsf{D}_2$$D2are more expressive than their original counterparts. Our results highlight that the non-Fregean connective$$\equiv $$≡can serve as a tool for expressing various properties of the ontology underlying the logics under consideration. (shrink)

This chapter brings together Murdoch’s thoughts about language with other central aspects of her thought such as love, attention, perfectionism and morality. By making clear how Murdoch’s variety of linguistic philosophy differs from contemporary philosophy of language, this paper also shows that Murdoch’s philosophy contains the seeds for a fruitful form of philosophizing which brings the moral and aesthetic dimensions of language into view. “Taking the linguistic method seriously” means making clear the ways in which all concepts belong to a (...) fabric that is changing on a personal level as well as an historical one. One of the things that Murdoch can help us see is that one problem with contemporary philosophy of language, is that it does not take the linguistic method seriously enough. (shrink)

Sex offenders are sometimes offered or required to undergo pharmacological interventions intended to diminish their sex drive (anti-libidinal interventions or ALIs). In this paper, we argue that much of the debate regarding the moral permissibility of ALIs has been founded on an inaccurate assumption regarding their intended purpose—namely, that ALIs are intended solely to realise medical purposes, not correctional goals. This assumption has made it plausible to assert that ALIs may only permissibly be administered to offenders with their valid consent, (...) in line with the approach taken to most other interventions with a medical aim. However, we argue that, contrary to this assumption, the state's intention in relation to at least some ALIs is, at least in part, to achieve correctional objectives. We evaluate two legal regimes for ALI provision—section 645 of the California Penal Code and the mental health regime in England and Wales. In each case, we identify the state's implicit purpose in imposing ALIs and argue that the Californian and English regimes both serve as counterexamples to the view that ALIs are intended solely for medical purposes. While the moral implications of our argument are not straightforward, it raises the question whether consent is required for permissible imposition of ALIs, and more generally, whether the moral permissibility of crime-preventing interventions using medical means should be assessed against the standards of medical ethics or against those of criminal justice ethics. This editorial presents the background for the article collection ‘ELSA and RRI’. It sets the stage for the topics discussed in the collection and briefly presents the different contributions. It concludes by opening up for continued discussion of the relations between ELSA and RRI.

How is one to navigate between a thinking grounded in the individual and a claim for communality? In Emerson, this kind of difficulty comes into view in familiar sentences such as Speak your latent conviction, and it shall be the universal sense.’ How does the relationship between the personal and the universal look and function? In this paper, it is argued that Emerson may bring us clarity regarding the difficulties we are facing when it comes to questions about how we (...) are to frame human personality, morality, and knowledge in the field of tension created by distinctions such as private/public, original/conventional, and particular/universal. A crucial thought in this line of reasoning is that that the critical philosophy Emerson pursues is also self-critical. The idea that true critique is self-criticism is then used as a tool to make clear that there’s no fundamental gap to be bridged here. This article explores one central assumption that is guiding large portions of contemporary (analytic) moral philosophy: the idea that moral philosophy has to be forward-looking and action-guiding. By paying attention to a number of examples, it is argued that this guiding assumption flies in the face of important aspects of actual moral life. Moral situations are not (always) of the nature that we can plan for them, and reason about them in advance. Rather, the moral reality, or the moral contexts, (...) are often such that the moral situation is created in the scene, and hence something that is only available to reflect upon in hindsight. There are, at least, two central reasons why this is so: The first is that the sense, meaning, of the actions and the concepts we use in reflection about them, are not locked beforehand, and our understanding of them are formed in the process. The second reason is that moral situations come about in a responsive, rather than planned, way. That is, we discover our moral world by means of our reactive interactions, rather than in theoretical reflection that aims to produce “anticipated beliefs.” Thus, this article suggests a way of exploring morality’s backward-looking nature that does not misrepresent moral reality. How leaders and managers respond to not knowing is highly relevant given the complex, ambiguous, and chaotic business environment of the twenty-first century. Drawing on the literature from a variety of disciplines, the paper explores the dominant, unfavorable conceptualization of not knowing. The authors present some potential ethical implications of a negative view of not knowing and suggest how organizations would benefit from identifying any unhelpful aspects of the culture that may encourage unethical, undesirable, and/or hasty actions in situations of (...) not knowing. The paper specifically illustrates how patience, courage, honesty, integrity, and humility are integral to negative capability in the contexts of not knowing. Finally, the paper calls for deeper inquiry into the role of virtue ethics in preparing managers and leaders for not knowing and urges organizations to embrace negative capability in not knowing rather than engaging in damaging delusion. A person who is liable to defensive harm has forfeited his rights against the imposition of the harm, and so is not wronged if that harm is imposed. A number of philosophers, most notably Jeff McMahan, argue for an instrumental account of liability, whereby a person is liable to defensive harm when he is either morally or culpably responsible for an unjust threat of harm to others, and when the imposition of defensive harm is necessary to avert the threatened unjust (...) harm. Others may favour a purely noninstrumental account of liability: one that looks only to the past behaviour of the potentially liable person. We argue that both views are vulnerable to serious objections. Instead we develop and defend a new view of liability to defensive harm: the pluralist account. The pluralist account states that liability to defensive harm has at least two bases. First, if an attacker is morally or culpably responsible for an unjust attack then he has forfeited what we call his agency right, and in doing so he has made himself partially liable to defensive harm. Whether the attacker is fully liable to defensive harm depends, however, on whether the imposition of defensive harm would infringe a different right held by the attacker: his humanitarian right. Humanitarian rights are rights to be provided with urgently needed resources or to be protected from serious harms when others can do so at reasonably low cost. We argue the pluralist account avoids the objections to which the instrumental and noninstrumental views are vulnerable, coheres with our intuitive reactions in a wide range of cases, and sheds new light on the way different rights combine to determine a person's liability to suffer harm. In an article titled, "Who Shall Live When Not All Can?", James Childress proposes a system for allocating scarce lifesaving medical resources based on random selection procedures. Childress writes of random selection procedures, [They] "cannot be dismissed as a ‘non-rational’ and ‘non-human’... without an inquiry into the reasons, including human values which might justify it." My thesis is that once we concentrate on determining the rationality of random selection procedures, we will see that Childress's claim that we cannot dismiss such (...) procedures as ‘non-rational’ is open to question. My claim will be that while both random selection and social worth procedures are rationally defensible systems, random selection procedures easily lead to specific choices that are objectively irrational, apart from the limited perspective of the random selection process itself. Drawing upon Aristotle’s claim that when one wants to learn right conduct or virtue, one should emulate those who practice it, this paper describes reasons for how the clear and conscious development of nursing role models can be used to model virtue theory in applied ethics courses. After providing a brief summary of Aristotle’s virtue ethics, the paper turns to a description of the basic models that describe the role of a nurse: surrogate mother, patient’s advocate, traditional caregiver, and trained (...) clinician. With these models in hand, the paper illustrates how virtues and duties can change when the role of the nurse changes and how different models of the nurse’s role connect virtue to practical action in different ways. Finally, the paper concludes with an extension of the above discussion to other areas of professional ethics and a step-by-step procedure for determining occupational duties. (shrink)

Jan Patočka opens “The Phenomenology of Afterlife” by indicating that philosophers always tend to focus on questions about the mortality or immortality of the soul when thinking about death, and that he wants to take a different route focusing instead on the phenomenology of the afterlife and the ways the diseased others live in us. And this is what the major bulk of the text focuses on. But as Patočka’s unfinished text is about to end, he leaves us with a (...) peculiar addendum that signals that a return to the more traditional questions – about death as mine – is necessary. In this text, I seek to elucidate what the phenomenology of afterlife brings to the traditional discussion about death as mine (and about my “soul”). One of the more prominent and well-developed modern theories that discuss death as mine is Derek Parfit’s. Thus, the effort in this text is to find out what Patočka’s phenomenology can teach us about Parfit’s theory. (shrink)

Heidegger and ethics is a contentious conjunction of terms. Martin Heidegger himself rejected the notion of ethics, while his endorsement of Nazism is widely seen as unethical. This major new study examines the complex and controversial issues involved in bringing them together. By working backwards through his work, from his 1964 claim that philosophy has been completed to _Being and Time_, his first major work, Joanna Hodge questions Heidegger's denial that his enquires were concerned with ethics. She discovers a (...) form of ethics in Heidegger's thinking which elucidates his important distinction between metaphysics and philosophy. Against many contemporary views, she proposes therefore that ethics can be retrieved and questions the relation between ethics and metaphysics that Heidegger had made so pervasive. (shrink)

A number of factors-new research into human and animal consciousness, a heightened awareness of the methods and consequences of intensive farming, and modern concerns about animal welfare and ecology-have made our relationship to animals an area of burning interest in contemporary philosophy. Utilizing methods inspired by Ludwig Wittgenstein, the contributors to this volume explore this area in a variety of ways. The way that Metaphysics as a Guide to Morals begins may seem perplexing since it does not state in a clear way what the aims and purposes of the book are, nor does it say anything about methodology. This chapter aims to show how this peculiar opening, rightly understood, functions as an entrance to an understanding of the book as a whole, and to make clear why the opening chapter’s focus on the concept of art is the right place to (...) start. Murdoch’s view of metaphysics is that we are always guided by a worldview, i.e. by unified images that are historical and changing. Art functions as a mirror of its time that help to bring the background of our lives and thoughts into view. (shrink)

Concerns have been voiced about the ethical implications of patenting practices in the field of biotechnology. Some of these have also been incorporated into regulation, such as the European Commission Directive 98/44 on the legal protection of biotechnological inventions. However, the incorporation of ethically based restrictions into patent legislation has not had the effect of satisfying all concerns. In this article, we will systematically compare the richness of ethical concerns surrounding biotech patenting, with the limited scope of ethical concerns actually (...) addressed in the patent system. As sources of our analyses we will use literature and document studies and a survey with important stakeholders and experts related to Norwegian patenting in the aquacultural biotechnology sector. We will structure the analyses with an ethical matrix, developed for this purpose. Showing the misalignment of the discussions within and outside the patent system, we suggest that an important reason for the ethical controversy still surrounding patenting is that ethical questions keep being framed in a narrow way within the system. Until a richer set of ethical considerations is addressed head-on within the patent system, the patent system will continue to evoke academic and interest group criticism, potentially contributing to a legitimacy crisis of the whole system. This article discusses outcomes of a dialogue conference on ‘The road ahead for ELSA in Norway: Issues of quality, influence and network cooperation’ held in Oslo in December 2012. Norwegian researchers in the field of ethical, legal and social aspects of technologies were invited to discuss conceptual and strategic issues, as well as the setup of a researcher network. In the article I take an institutionalist approach and discuss challenges in institutionalising an ELSA network at a time when a designated (...) ELSA funding programme is coming to an end. The research question is how the Norwegian ELSA network can succeed as a persistent network in times of greater uncertainties. The article claims that the network needs to gain legitimacy, outlines different dimensions of legitimacy and interprets the conference discussions in light of these dimensions. Central challenges and success factors facing the ELSA network are discussed and the article concludes with reflections on the potential future of ELSA in Norway. Although the article has a Norwegian context, the discussions in the article are likely to be relevant for researchers all across Europe, as similar developments are taking place also elsewhere in the European research funding context. Unprecedented advances in medicine, genetic engineering, and demographic forecasting raise new questions that strain the categories and assumptions of traditional ethical theories. Heyd's approach resolves many paradoxes in intergenerational justice, while offering a major test case for the profound problems of the limits of ethics and the nature of value.

There is an abundance of enthusiasm and optimism about how governments at all levels can make use of big data, algorithms and artificial intelligence. There is also growing concern about the risks that come with these new systems. This article makes the case for greater government transparency and accountability about uses of big data through a Government of Canada qualitative research case study. Adapting a method from critical cartographers, I employ counter-mapping to map government big data practices and internal discussions (...) of risk and challenge. I do so by drawing on interviews and freedom of information requests. The analysis reveals that there are more concerns and risks than often publicly discussed and that there are significant areas of silence that need greater attention. The article underlines the need for our democratic systems to respond to our new datafied contexts by ensuring that our institutions make changes to better protect citizen rights, uphold democratic principles and ensure means for citizen intervention.
